LORD, WE THANK YOU FOR OUR ABILITY TO GET UP AND ENJOY THIS, THIS BEAUTIFUL WORLD THAT YOU'VE ENJOYED. AND LORD, WE ASK A SPECIAL PRAYER ALWAYS UPON THOSE SERVICE MEMBERS, MEN AND WOMEN THAT ARE FIGHTING AND SACRIFICING TO PROTECT OUR COUNTRY AND GIVE US THE RIGHT TO COME AND JOIN HERE THIS MORNING IN DECEMBER. THE COUNTY MANAGER. MISTER CHAIRMAN, COMMISSIONERS FIRST ON THE AGENDA WILL INVITE OUR PUBLIC DEFENDER TO GO UP. AND DISCUSS ANYTHING LIKE WHAT'S. GOOD. MORNING. GOOD MORNING. MY NAME IS RICARDO SAMPER. I GO BY RICK. I'VE MET SEVERAL OF YOU. I WOULD LIKE TO, AT SOME POINT, TO HAVE THE OPPORTUNITY TO MAYBE SIT DOWN AND EXPLAIN TO YOU WHAT OUR DAY TO DAY LOOKS LIKE AND THE PROCESSES THAT WE GO THROUGH SO THAT Y'ALL UNDERSTAND. I THINK TRADITIONALLY MY OFFICE, WE HAVE NOT DONE A GOOD JOB AT EDUCATING PEOPLE EXACTLY WHAT ALL WE DO TO GET OUR MISSION ACCOMPLISHED. I'M BEFORE YOU TODAY. I'M ASKING, AND I REALIZE THAT I HAVE A BIG ASK OF THIS BOARD. I'M ASKING Y'ALL TO INCREASE MY FUNDING BY GIVING ME ANOTHER POSITION. I'M ASKING FOR ANOTHER ATTORNEY, AND I'M ASKING THAT THE STARTING SALARIES FOR ATTORNEYS IN MY OFFICE GO FROM 65,000 TO 72,000. THE REASON I'M DOING THAT IS Y'ALL ARE ALL AWARE HIRING HAS GOTTEN TO BE A LOT MORE DIFFICULT, PARTICULARLY WHEN WE ARE COMPETING WITH SO MANY OTHER PLACES FOR THE POOLS OF PEOPLE THAT ARE GRADUATING OUT OF LAW SCHOOLS RIGHT NOW. THE STATE HAS AUTHORIZED AND IS BEGINNING PEOPLE STARTING SALARIES AT 72,000, WHICH LEAVES ME IN SOMEWHERE LIKE TROUP COUNTY, COMPETING AGAINST MY OWN AGENCY, TRYING TO HIRE PEOPLE BECAUSE THEY CAN GO TO OTHER COUNTIES AND WHAT HAVE YOU AND MAKE MORE MONEY, AND IN SOME PLACES FOR LESS WORK. I WAS APPOINTED TO BE THE CIRCUIT PUBLIC DEFENDER FOR THE SPLIT CIRCUIT FOR THE COUNTY JUDICIAL CIRCUIT ON JANUARY 1ST. SINCE THEN, I HAVE LOST TWO ATTORNEYS OUT OF MY TROUP COUNTY OFFICE. I HAVE MANAGED TO REPLACE ONE OF THEM. I HAD SOMEBODY THAT WE WERE GOING TO INTERVIEW LAST THURSDAY, WHO ON WEDNESDAY SENT ME AN EMAIL AND SENT TO MR. JEFF SHADDOCK, MY OFFICE MANAGER, HERE, AND EMAILED SAYING I HAD ANOTHER INTERVIEW AND I'M GOING TO ACCEPT THAT POSITION. A LOT OF THAT IS BECAUSE EVERYBODY ELSE IS STARTING AT AT LEAST 72. I WAS SPEAKING WITH MISS MARY ELLEN SIMMONS THIS PAST FRIDAY, WHO IS THE CIRCUIT PUBLIC DEFENDER FOR THE NEW WEST GEORGIA CIRCUIT, WHO INDICATED TO ME THAT THEY HAD ALREADY GONE UP WITH THEIR STARTING SALARIES OF 72. SO THAT KIND OF PUTS US IN A. BIG DISCREPANCY, TRYING TO GET PEOPLE HIRED TO TAKE THE POSITIONS HERE AND EVEN BEING ABLE TO RETAIN PEOPLE BECAUSE ONE OF THE ONES I LOST WENT TO MUSKOGEE COUNTY, WHERE THEY WERE GOING TO PAY HER 12,000 MORE A YEAR THAN WHAT WE WERE PAYING HER HERE, AND TOLD HER THAT SHE WOULD HAVE AT LEAST 100 LESS CASES PER YEAR TO HAVE TO WORK.

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

AREN'T GETTING THROUGH AND GETTING ATTENDED TO BECAUSE THERE'S NOT SO MUCH THAT WE CAN DO, IF THAT MAKES ANY SENSE. AND SO I'M ASKING YOU TO TAKE THAT INTO CONSIDERATION WHEN GOING OVER THIS BUDGET REGRESSION. I NEED TO TRY TO KEEP PEOPLE. AND SO FAR OUT OF THE FOUR SUPERIOR COURT ATTORNEYS I HAD, I LOST TWO OF THEM. I'VE BEEN ABLE TO REPLACE ONE, AND I THOUGHT I HAD A GOOD CANDIDATE WHO AT THAT POINT TURNED AROUND AND WENT ELSEWHERE. AND I GOT A FEELING THAT'S BECAUSE THE DIFFERENCE IN EVERYBODY ELSE STARTED AT 72. I'M ALSO ASKING FOR INCREASES IN MY STAFF, MY ADMINISTRATIVE STAFF, WHICH IS MY INVESTIGATOR, AND MY TWO ADMINISTRATIVE ASSISTANTS. I'M ASKING THE COURT TO CONSIDER, I MEAN, I'M USED TO BEING IN COURT IN THE MIDDLE OF A JURY TRIAL WEEK IN COWETA COUNTY RIGHT NOW. SO I APOLOGIZE FOR THAT. BUT I'M ASKING THIS BOARD TO CONSIDER GIVING THEM A $3,000 COST OF LIVING INCREASE THIS YEAR AS WELL. THE DIFFERENCE IN MY REQUEST FROM WHAT HAD BEEN FUNDED BEFORE. IS IF I CAN FIND WHAT I DID WITH MY NOTES, I'M JUST A LITTLE BIT NERVOUS. THIS MORNING IS. $162,470.08. I REALIZE THAT A LOT, BUT I CAN ALSO TELL YOU THAT IN OUR OFFICE, WE TRY TO MAKE THE MOST OUT OF EVERY DOLLAR THAT Y'ALL GIVE US AND MAKE THE MOST OUT OF EVERYTHING THAT WE DO GET. ADDING THE ONE ATTORNEY WOULD BRING OUR CASELOADS DOWN. IT STILL WOULDN'T BRING THEM DOWN KIND OF WHERE IT WOULD, WHERE WE WOULD ALL NOT BE OVERWORKED. BUT EVERY LITTLE BIT OF HELP IS A HELP.

AND THAT'S WHY I'M ASKING FOR THAT POSITION AS WELL. ANYBODY HAS ANY QUESTIONS FOR ME, I'LL BE GLAD TO TRY TO ANSWER THEM AT THIS STAGE. WE CURRENTLY HAVE TWO ATTORNEYS. I CURRENTLY HAVE THREE. I WAS ABLE TO HIRE SOMEBODY TO REFILL THAT ONE, AND THAT STILL PUTS MY CASELOADS.

AND I'VE GOT THOSE FIGURES IF YOU'RE INTERESTED AT. I'VE GOT ONE ATTORNEY THAT'S GOT OVER 500 CASES RIGHT NOW, AND THAT'S BECAUSE WHEN I LOST TWO OF THOSE CASES, I CAN'T JUST SIT. THEY HAVE TO BE REASSIGNED TO SOMEBODY. WELL, I MANAGED TO HIRE SOMEBODY BACK WHO GOT A PORTION OF THOSE. BUT BY THE SAME TOKEN, THAT PERSON IS NOT VERY VERSED IN CRIMINAL LAW. SO WE'RE HAVING TO GO THROUGH A TRAINING PROCESS WITH HIM. HE HAD PRACTICED LAW FOR A CONSIDERABLE AMOUNT OF TIME, BUT JUST NOT DOING CRIMINAL LAW. SO HE'S GOT TO GET VERSED AND LEARN ALL THAT ASPECT TO IT. AND IT ALWAYS TAKES, YOU KNOW, WHEN YOU HAVE TIME TRAINING SOMEBODY AND WHEN YOU HAVE PEOPLE THAT ARE TRAINED AND YOU LOSE PEOPLE THAT ARE TRAINED AT THAT POINT, IT EVEN PUTS YOU FURTHER BEHIND BECAUSE YOU'VE GOT TO NOT ONLY DO THE TRAINING, BUT YOU GOT TO WORRY ABOUT RETAINING THE ONES THAT ARE OVERWORKED AS WELL. I DO FEEL LIKE WITH THE SALARY INCREASE THAT I KNOW, AND WE STRUGGLE EVERY TIME WITH THE LACK OF APPLICANTS WHEN IT COMES TO ATTORNEYS, YOU FEEL LIKE THAT THE INCREASED SALARY IS GOING TO ATTRACT MORE APPLICANTS FOR YOU.

I THINK IT WILL BE, YOU, AND WE HAVE SEEN A FEW MORE APPLICANTS THIS PAST YEAR. I'VE SEEN MORE APPLICANTS FOR AND WE ACTUALLY. INVOLVED IN TWO APPLICATIONS, THIS KIND OF THING. AND I HAVE SEEN SOME MORE APPLICANTS. LIKE I SAID, I HAD A GOOD ONE THAT UNFORTUNATELY SOMEBODY INTERVIEWED HIM BEFORE WE DID AND HE WENT SOMEWHERE ELSE AND LET US KNOW THE NIGHT BEFORE, LITERALLY THE NIGHT BEFORE THE INTERVIEW WITH AN EMAIL. AND SO THE OTHER THING THAT I'M DOING IS SOME PLACES WANT ATTORNEYS THAT HAVE ALREADY PASSED THE BAR. THE BAR CHANGED THEIR RULES AND REGULATIONS, WHERE I CAN HIRE PEOPLE THAT HAVE GRADUATED LAW SCHOOL AND UNDER A PROVISIONAL LICENSE IN PRACTICE, SO I CAN START THAT TRAINING UNTIL THEY TAKE THE BAR, WITH THE JOB BEING CONTINGENT UPON THEM PASSING THE BAR. AND I AM NOT ADVERSE TO HIRING PEOPLE IN THAT SITUATION. I HIRED THREE IN MY COWETA COUNTY OFFICE. TWO OF THEM WORKED OUT WONDERFUL. THE THIRD ONE, THEY ALL PASSED THE BAR. THE THIRD ONE, DUE TO PERSONAL CIRCUMSTANCES, WENT BACK INTO PRIVATE PRACTICE OR TOOK A JOB WITH A LARGE FIRM MAKING ALMOST DOUBLE WHAT I WAS PAYING HER IN COWETA. SO THAT ROLLED BACK DOWN TO A MONEY ISSUE, AND I REALIZED WE CAN'T COMPETE WITH PRIVATE PRACTICE IN THESE PRIVATE LAW FIRMS. AND I REALIZED THAT WE CAN'T COMPETE WITH A LOT OF OTHER COUNTIES LIKE FULTON COUNTY. UNFORTUNATELY, WE LIVE CLOSE ENOUGH TO THE BIG COUNTIES THAT ARE PUTTING A LOT OF MONEY IN SALARIES THAT WE HAVE TO FIND OTHER WAYS TO TRY TO ATTRACT PEOPLE DOWN HERE. SO MY UNDERSTANDING, RIGHT, YOU SAID THAT ONE OF THE ATTORNEYS LEFT AND HAD TO DO WITH CASELOAD. IT DID. AND SO ADDING THIS OTHER

THAT'S WHAT YOU'RE TRYING TO DO IS, IS SPREAD THAT. SO IN OTHER WORDS THAT ATTORNEY WOULDN'T HAVE LEFT IF SHE LEFT THAT OFFER THE 12TH AND SHE'S COMMUTING. SHE'S STILL RESIDES IN COOK COUNTY FLORIDA BECAUSE THEY OFFERED TO HELP OUT AND SOME OF THOSE CASES. ADDING ONE MORE ATTORNEY I DON'T THINK WOULD TURN AROUND AND DROP THE INDIVIDUAL CASELOADS BY 100 CASES APIECE A YEAR, BUT IT WOULD MAKE A DENT IN IT AND IT WOULD MAKE IT MORE ATTRACTIVE.

WE'RE ABOUT 24 MONTHS IN TO THE SERVICE CONTRACT WHERE WE PROVIDE CURBSIDE BACK DOOR. CONVENIENCE, SITE MANAGEMENT AND THEN, AS NEEDED, ROLL OFF SERVICES FOR THE COUNTY FROM MAJOR DEPARTMENTS. THESE ARE JUST SOME PICTURES OF OUR GUYS OBVIOUSLY COLLECTING IN THE SNOW WITH A CUSTOMER. AND THEN JUST ONE OF THE CONVENIENCE SITES. NEXT SLIDE ON THE RESIDENTIAL CURBSIDE COLLECTION. THE SERVICE

DAYS ARE CURRENTLY TUESDAY THROUGH FRIDAY. WE DON'T COLLECT ON MONDAYS CURRENTLY. WE DID THAT BECAUSE OF A LARGE MAJORITY OF MAJOR HOLIDAYS FALLING ON A MONDAY TO TRY TO IMPACT THE CUSTOMERS THE LEAST AMOUNT. WHEN WE ORIGINALLY BUILT THE PLAN, YOU KNOW, OBVIOUSLY WE DIDN'T KNOW HOW MANY CUSTOMERS THERE WOULD BE BECAUSE THE CONVENIENCE SITES WERE STILL GOING TO BE OPEN IN SOME CAPACITY. AND SO WE HAVE PROJECTED AROUND 10,000 CUSTOMERS. WE ONBOARDED FOR 90 DAYS FROM. FROM APRIL TO THE END OF JUNE FOR CUSTOMERS SIGNING UP. AND DURING THAT TIME WE ONBOARDED ABOUT 3200 CUSTOMERS. AND THEN ON. THE THURSDAY OR FRIDAY BEFORE THE JULY 4TH WEEKEND, WE STARTED JULY 1ST, WHICH WAS A SATURDAY ON AT THE CONVENIENCE SITES. BUT THEN THE FIRST PICKUP, THE ACTUAL FIRST PHYSICAL PICKUP DAY WOULD HAVE BEEN ON THAT TUESDAY, THAT FOLLOWING TUESDAY. BUT OVER THAT WEEKEND WE HAD ABOUT 2600 ADDITIONAL PEOPLE. EMAIL AND SIGN UP ONLINE. AND THEN OVER THE WHOLE FOUR WEEKS FOLLOWING, IT WAS ABOUT 3400 PEOPLE TOTAL.

AND SO IF Y'ALL REMEMBER, EVERYBODY PAYS THEIR OWN BILL IN THIS CONTRACT. AND SO EVERYBODY HAD TO BE PROCESSED, HAD TO BE SIGNED UP, PUT IN THE SYSTEM AS AN INDIVIDUAL CUSTOMER. AND WHICH IS WHY WE GAVE A 90 DAY ONBOARD PERIOD. BUT BUT ANYWAY, SO WE HAD TO DO THAT CREATED SOME CHALLENGES. WE HAD ALREADY BUILT ROUTES. WE HAD ALREADY COVERED THE WHOLE COUNTY WITH PLACING CARTS, BUT WE HAD TO GO BACK. I DON'T EVEN KNOW HOW MANY TIMES, BUT WE GOT THEM OUT. BY AUGUST OF 23, WE WERE UP TO 6600 TOTAL CUSTOMERS. JANUARY 1ST OF 24, WE'RE AT 8051 OF 25.

APPROXIMATELY 8400 CUSTOMERS. THAT NUMBER FLUCTUATES. YOU'LL SEE LATER THAT DEPENDING ON BILL PAY OR PEOPLE MOVING IN AND OUT OF THE AREA, IT FLUCTUATES QUARTERLY, YOU KNOW, BETWEEN 200 AND 400, A LITTLE MORE THAN 400 PEOPLE A QUARTER. INITIALLY, WE OFFERED QUARTERLY AND ANNUAL BILLING, BUT LATER, ONCE YOU PAID FOR THE FIRST QUARTER TO MAKE SURE YOU GOT YOUR ROLL CART, YOU YOU WERE, WE DECIDED TO ALLOW PEOPLE IF THEY WOULD SIGN UP FOR AUTO PAY, TO PAY MONTHLY, AND THAT HELPS SOME PEOPLE OUT. WE ALSO ADDED THE OPTION WHERE WE GAVE SENIOR, VETERAN AND ANNUAL DISCOUNTS, WHICH ONCE AGAIN WAS NOT INSIDE OF THE ORIGINAL AGREEMENT. THESE ARE THE CONSOLIDATED AREAS. YOU'LL SEE THAT THE BLUE IS SPLIT A LITTLE BIT. THAT HAS A LITTLE BIT TO DO WITH THE LAKE AREA. AND WHAT MADE SENSE FROM A CAPACITY STANDPOINT. NEXT SLIDE.

WE HAVE ABOUT 694 THAT FLUCTUATES. THAT GETS UP TO AROUND 700 SOMETIMES NEVER REALLY FALLS BELOW 650. BUT BACK DOOR SERVICE CUSTOMERS AND THAT IS A SERVICE THAT YOU, IF YOU ARE DISABLED, HAVE NO ONE ELSE ABLE BODY IN THE HOUSEHOLD.

YOU CAN GET WITH A DOCTOR'S NOTE AT NO ADDITIONAL CHARGE FROM YOUR REGULAR FEE. TYPICALLY THOSE PEOPLE ARE ELDERLY, SO THEY THEY ARE ALSO GETTING, YOU KNOW, A SENIOR DISCOUNT.

THE ONE THING THAT WE DID ADD TO THIS AFTER THE FACT WAS THERE WERE SEVERAL PEOPLE THAT SAID, HEY, I LIVE ALONE, I ONLY HAVE ONE BAG OF TRASH A WEEK, AND SO I DON'T MIND GOING TO THE CONVENIENCE SITE. AND SO WE ADDED A PUNCH CARD THAT WAS WAS DIFFERENT THAN WHAT YOU GET WHEN YOU SIGN UP FOR CURBSIDE SERVICE. AND IT'S, IT'S $25 AND IT HAS I CAN'T REMEMBER THE EXACT AMOUNT, BUT I THINK IT'S TEN PUNCHES ON THERE AND EACH PUNCH IS A BAG. SO WE HAVE SEVERAL PEOPLE THAT BUY THOSE CARDS THAT REALLY THAT LAST THEM A FEW MONTHS. AND SO THEY'RE PAYING $10 OR I'M SORRY, $25, BUT IT'S LASTING THEM SOMETIMES

WE'VE BROUGHT IN ADDITIONAL CONTAINERS AND STUFF LIKE THAT. BUT FOR THE MOST PART, THE BIG THING THAT I'M PROUD OF IS THAT WE HAVE MISSED NO DAYS OR HOURS OF SERVICE TO THE CUSTOMERS. NOW WE HAVE HAD OVER THE LAST TWO YEARS, PEOPLE THINK OR MAYBE NOT BE SURE ABOUT THE ACTUAL HOURS OF THE SITES ARE OPEN, THE COMMUNITY SITES ARE OPEN AND THEY HAVE NOT CHANGED. THE HOURS HAVE NOT CHANGED. SO OBVIOUSLY MONDAY IS 7 A.M. TO 7 P.M, THURSDAY 7 A.M. TO 7 P.M, FRIDAY 7 A.M. TO 7 P.M, AND THEN ON SUNDAY IT IS 1 TO 7 P.M. AND SO IT'S 40 43 HOURS I THINK A WEEK THAT IT IS OPEN. WE HAVE HAD NO RECORDABLE INJURIES AT THE SITES. TO OUR KNOWLEDGE, THERE HAVE BEEN NO CUSTOMERS THAT HAVE BEEN INJURED. THERE HAVE BEEN NO EMPLOYEES THAT HAVE BEEN INJURED. WE ALLOW CIVIC AND VOLUNTEERS TO DONATE FREE. THERE'S SEVERAL PEOPLE THAT PICK UP TRASH ON THE SIDE OF THE ROAD. WE APPLIED AND RECEIVED THE GRANT ON APRIL 10TH. WE WERE NOTIFIED THAT THERE WERE SUPPLEMENTAL FUNDING INCLUDED AS WELL, IN THE AMOUNT OF $18,585. IF ALLOWED TO ACCEPT. THIS BRINGS THE TOTAL GRANT AMOUNT TO $78,585. THE PURPOSE OF THE INFANTILE COURT PROGRAM IS TO IMPROVE SYSTEMS AND SERVICES SUPPORTING YOUNG CHILDREN AGES 0 TO 3 AND THEIR FAMILIES WHO ARE INVOLVED OR AT RISK OF INVOLVEMENT WITH THE CHILD WELFARE SYSTEM. THERE WAS A CONSULTANT AS WELL THAT HELPED MAKE THAT FIRST DRAFT OF THE UDO, AND THEN LEGAL COUNSEL WAS INVOLVED SEVERAL MEETINGS WITH COUNTY ATTORNEYS. WHEN WE WERE LOOKING AT REVISING SECTIONS OF THE UDO OR THE CURRENT ORDINANCE TO ADAPT INTO THE UDO BOARD OF ZONING APPEALS AND PLANNING COMMISSION PLAYED A HUGE ROLE IN THE REVIEW OF THIS DOCUMENT. AND NOW WE HAVE THE FINAL DRAFT THAT IS POSTED FOR PUBLIC COMMENT. SO I WILL SAY WITH THE BOZA, THIS WAS PRESENTED TO THEM IN APRIL, AND EVEN PRIOR TO THAT THEY HAD THE DRAFT AND WE REQUESTED COMMENTS, REVIEW AND CONCERNS FROM THEM.
